JCT (Joint Contracts Tribunal) Clause 21.2.1. insurance, similar to JCT Clause 6.5.1 cover and sometimes referred to as "small works" or "non-negligence insurance"
A contract specific policy designed to insure and protect the Employer and Contractor in respect of their legal liability for expense, liability, loss, claims or proceedings that arise due to non-negligent injury or damage to any property whilst undertaking a building contract due to collapse, subsidence, heave, vibrations, weakening or removal of support or lowering of groundwater attributable to the carrying out of the works, but not due to any negligence of the contractor or design.
The policy will usually be arranged in joint names of the Employer and Contractor, but in respect of Property Owners or Developers who are undertaking the contract works themselves, the policy can be issued solely in their own name.
Cover will exclude injury or loss of or damage to any property where cover is provided by any other insurance, which is the responsibility of the Employer to insure under paragraph C.1 of schedule 3 within the JCT Standard Building Contract 2011 (Damage to existing structures and their contents for Specified Perils).
